Terms and Conditions for Resale Platform Users

Preamble

See Tickets AG (hereinafter "SEE") offers a Resale Platform for eligible orders placed through www.seetickets.com/ch or affiliated partner websites. On this platform, individuals who have placed orders with SEE can offer eligible tickets for resale. The sale takes place between users of the Resale Platform. SEE is not a party to the purchase contract but merely provides the Resale Platform.

The resale process is as follows: To resell a ticket, the seller must first create an account on the Resale Platform. After successfully validating their email address, all tickets eligible for resale will be displayed. The seller can then select a ticket and list it for sale on the Resale Platform. Once successfully listed, the ticket is publicly visible on the platform. The buyer can then purchase the listed ticket. Once a ticket is successfully resold, the seller’s ticket becomes invalid, and the buyer receives a new, valid ticket. At the same time, the proceeds from the resale become visible in the seller’s resale account. The seller must then create a Stripe account to transfer the proceeds to their bank account.

1. Inclusion of the General Terms and Conditions for Ticket Buyers of See Tickets AG

1.1. In addition to these resale terms and conditions (hereinafter "T&Cs"), the General Terms and Conditions for Ticket Buyers of See Tickets AG (hereinafter "GTCs") also apply, as explicitly referenced in these T&Cs. By accepting these T&Cs, users of the Resale Platform also agree to the relevant provisions of the referenced GTCs. When a ticket is sold through the Resale Platform, the rights and obligations of the original ticket buyer under the T&Cs and GTCs transfer to the new ticket buyer.

1.3. In the event of any conflict between these T&Cs and the provisions of the GTCs, these T&Cs take precedence unless explicitly stated otherwise in the GTCs. The GTCs apply in all matters not specifically regulated by these T&Cs or where these T&Cs explicitly refer to the GTCs.

1.4. Resale Platform Users acknowledge that the liability provisions, limitations, and obligations set out in the GTCs are just as binding as those set out in these T&Cs. All liability, risk transfer, and warranty provisions in the GTCs apply to the extent legally permissible, without restriction, and in addition to these T&Cs.

2. Selling Tickets via the Resale Platform

2.1. The resale of tickets is permitted for private purposes only. If SEE suspects commercial resale, it reserves the right to delete the listing and block the seller.

2.2. It is the responsibility of the event organizer to determine whether tickets for their events may be resold on the Resale Platform.

2.3. The organizer or SEE may restrict or prohibit the resale of certain ticket types, especially for free, discounted, or box-office tickets.

2.4. The organizer or SEE may impose additional conditions for resale, such as requiring that only the original ticket purchaser resells the ticket.

2.5. The organizer or SEE may set a maximum or minimum resale price.

2.6. The organizer and SEE may charge fees for resale transactions.

2.7. To list tickets for resale, the seller must create an account on the Resale Platform and ensure their email address and personal details are up to date. Our preferred method of contact is email. The seller must therefore ensure they provide a valid and up-to-date email address. Additionally, it is the seller's responsibility to ensure that messages from SEE are not treated as spam or junk mail by their email provider.

2.8. As soon as a ticket has been successfully listed for resale, the offer appears on the Resale Platform. This offer is publicly accessible. The seller acknowledges that personal information may be visible in the listing and expressly agrees to this.

2.9. If an organizer cancels a ticket after it has been listed, the ticket cannot be resold. The seller must remove the listing immediately.

2.10. SEE or the organizer may set a deadline after which unsold ticket listings will be automatically deleted. Deleting the listing from the Resale Platform has no impact on the validity of the tickets.

2.11. Until the ticket is successfully resold, it remains valid, and the seller can use it without restriction in accordance with the GTC. SEE does not guarantee that any of the tickets offered for resale will actually be sold. There is no entitlement to a refund for unsold tickets.

2.12. The seller must remove their listing immediately if they decide not to sell. A listing cannot be removed if the ticket is in a shopping cart.

2.13. The successful resale of tickets is communicated to the seller via email and can be viewed in the Resale Platform account.

2.14. Upon a successful resale, the barcode of the seller’s tickets becomes invalid. The seller can no longer print the resold tickets and is no longer entitled to attend the event or claim the services included in the resold tickets. Furthermore, the right to a refund of the ticket price due to event cancellation is forfeited.

2.15. A successful resale transaction is final and cannot be reversed.

3. Payouts to Sellers

3.1. Once the ticket has been successfully resold, the amount is displayed in the seller's Resale Platform account. To receive the funds, the seller must first create a "Stripe Connect" account with the external company Stripe and then manually initiate the payout in the Resale Platform account.

3.2. By creating a "Stripe Connect" account, the seller agrees to Stripe’s terms and conditions, available at https://stripe.com/ch/legal/connect-account. Refunds are exclusively processed by Stripe. SEE does not store banking details.

3.3. It is the sole responsibility of the seller to ensure that all information required for the refund, such as the correct banking details, is complete and accurate. To the extent permitted by law, SEE assumes no liability for refunds that are transferred to the wrong bank account due to incorrect or incomplete banking information.

3.4. Payouts can only be made to bank accounts within the SEPA region.

3.5. The organizer or SEE may determine that refunds, despite the creation of a Stripe account and a submitted refund request, will only be processed after the event has ended.

3.6. SEE processes payments in Swiss Francs. The seller bears any international transfer fees.

4. Buying Tickets via the Resale Platform

4.1. The buyer acknowledges that the seller sets the ticket price, which may differ from prices on www.seetickets.com or partner sites.

4.2. The buyer is responsible for verifying before purchase whether the ticket grants them unrestricted access to the event or if additional conditions must be met. This applies particularly, but not exclusively, to discounted tickets offered for children and young people, students, or recipients of Old-Age and Survivors' Insurance (OASI). These groups are often required to present a valid ID at the entrance. To the extent permitted by law, SEE is not liable for denied entry if the buyer does not meet the necessary requirements.

4.3. The buyer acknowledges that SEE or the organizer may limit the number of tickets per shopping cart or per buyer for certain events.

4.4. SEE or the organizer may charge a service fee per ticket or per order. All additional fees are visible before the completion of the order.

4.5. The buyer acknowledges that payment transactions are processed through the external platform Stripe. No credit card information is stored on SEE's website.

4.6. A purchase is considered successfully completed when the buyer receives a confirmation via email and the order is visible in their Resale Platform account.

4.7. Upon a successful purchase, the buyer acknowledges the rights and obligations arising from the GTCs. There is no entitlement to a ticket for incomplete purchase transactions.

4.8. The buyer acknowledges that a ticket purchased on the Resale Platform can no longer be resold.

5. Ticket Delivery to Buyers

5.1. Once a purchase is complete, the seller’s ticket becomes invalid, and the buyer receives a new, valid ticket. The organizer may restrict ticket printing until shortly before the event.

5.2. Some tickets may require personalization. Buyers must provide details of all attendees for entry.

6. Handling of Personal Data and Miscellaneous Provisions

6.1. Resale Platform Users acknowledge that SEE and its service providers process personal data for platform maintenance and service provision. SEE’s Privacy Policy provides details on data handling.

6.2. The resale of tickets and these terms and conditions (including all contractual or non-contractual matters arising in relation to these T&Cs) are governed by Swiss law. Jurisdiction for any disputes related to the use of the resale platform, website, or services shall be, at SEE's discretion, either the courts at SEE's registered office or the buyer's place of residence. Conflict-of-law provisions and the provisions of the UN Convention on Contracts for the International Sale of Goods (CISG) are excluded.

6.3. These T&Cs are available in German, French, and English. In case of discrepancies, the German version prevails.
